Alaska Gov. Sarah Palin unlawfully pushed to have her former brother-in-law fired as a state trooper, the chief investigator of an Alaska legislative panel concluded Friday.
Investigator Stephen Branchflower said in his report that Palin violated a statute of the Alaska Executive Branch Ethics Act that prohibits public officials from using their office for personal gain.
The report does not recommend sanctions or a criminal investigation.

The inquiry looked into her dismissal of Public Safety Commissioner Walter Monegan, who said he lost his job because he resisted pressure to fire state trooper Mike Wooten, who was involved in a bitter divorce with Palin's sister.
Palin says Monegan was fired as part of a legitimate budget dispute. Branchflower said that Monegan's refusal to fire Wooten was a "substantial factor" in his dismissal but was not the only reason. Palin did have the authority to dismiss Monegan, the report said.
"I feel vindicated," Monegan told the Associated Press. "It sounds like they've validated my belief and opinions. And that tells me I'm not totally out in left field."
"I disagree," said Palin attorney Thomas Van Flein. "In order to violate the ethics law, there has to be some personal gain, usually financial. Mr. Branchflower has failed to identify any financial gain."
The investigation revealed that Palin's husband, Todd, has extraordinary access to the governor's office and her closest advisers. He used that access to try to get Wooten fired, the report found. Palin should have taken action to stop that, the report concluded.
Branchflower also said there was evidence the governor participated in the pressure, as well.
Before Palin became governor, Wooten faced disciplinary action over allegations that he drank beer in a patrol car and used a Taser on his pre-teen stepson.
Former Alaska State Trooper Col. Julia Grimes told investigators that Sarah Palin called her in late 2005 to discuss why Wooten hadn't been fired, and Grimes told her the inquiry was confidential by law.
"Her questions were how can a trooper who behaves this way still be working," Grimes said. "I asked her to please trust me, that because I can't tell her details I would ask her to please trust me that I would take the appropriate action if and when I knew what the findings were. ... I couldn't have another conversation with her about it because, again, it's protected by law."
Grimes said Todd Palin also contacted her by telephone in late 2005 to discuss the confidential investigation of Wooten.
Wooten's disciplinary case was settled in September 2006 — months before Palin was elected governor — and he was allowed to continue working as a trooper.
After Palin's election, her new public safety commissioner, Monegan, said he was summoned to the governor's office to meet Todd Palin, who said Wooten's punishment had been merely a "slap on the wrist." Monegan said he understood the Palins wanted Wooten fired. "I had this kind of ominous feeling that I may not be long for this job if I didn't somehow respond accordingly," Monegan told the investigator.

Let's see, the decision was released 4 weeks before an election, by a mostly Democratic comittee. Also, the nearly 300-page report does not recommend sanctions or a criminal investigation.
It's not just that a bipartisan panel has formally found that Palin improperly abused her power as governor. It's that Palin has consistently lied about it. She claimed that she fired Monegan because 'she wanted to take the department in another direction,' a suspiciously vague and Gonzo-like rationale. And not that's shown to be a lie. So, how can she possibly claim that her opponents can't be trusted because of who they associated with years ago when she's been conclusively shown to have abused the public trust in her current role? I think she forgot the old rule about casting the first stone....

Sarah was found guilty by Legislature. This means if McCain wins presidency, Sarah Palin will surely be immediately impeached and McCain can re-fill the VP position with someone that he really wanted. (way to go Republicans, you found a way to use her pretty face, then stuff her away once elected.)
But if democrats win, she won't be resuming her role as Governor without being brought up on charges.
Either way...Sarah has already lost.

What a crock. The guy wouldn't fire a trooper who stunned his son with a TASER. He deserved to be fired, and the trooper deserves to be prosecuted.

When will people talk about Palin's lack of education? I, too, have a broadcast journalism degree (although I was able to attend only 1 college, not 6). That degree only makes you able to communicate well...it does NOT teach anything about global economics, world diplomacy, or constitutional law. I am a registered republican who MUST vote the other way this time.
Explain something to me. The probe was launched to determine whether Palin abused her power in firing Monegan, not in trying to get Wooten fired. They found she had every right to fire/reassign Monegan. But they had to go on and smear her by saying she violated an ethics law that has never before been applied except in dealing with financial cases, and only then of some "significant" amount. How did trying to get Wooten fired personally benefit her or her family? You make no mention that he threatened to kill her father. Does that not give the family reason to be worried? Is the removal of such a person (who is to this day still a state trooper, by the way) not of some benefit to the state and people of Alaska?
Why doesn't the media ever try reporting the facts as they are - not selectively, and not the facts as you'd like them to be. When the media eventually gets buyers remorse from an Obama presidency (and you will) we'll all be here to have a good laugh.
The ONLY thing Palin is qualified to be is a Republican.
Before the republicans say this report was a partisan attack, there were 10 REPUBLICANS and 4 DEMOCRATS who asked for the investigation before she was tapped as VP. Again, 10 REPUBLICANS and four democrats requested this investigation. Ten republicans and 4 democrats released the report by UNAMIMOUS decision. I guess there are people who stand up, and want the truth to come out. Three cheers for the Republican Party in Alaska. The bigger question is why was her husband involved when this was a state matter. He did not work for the state, but used state resources to advance his agenda. If this was acceptable business dynamics, I guess I could be fired because my boss's wife doesn't like me.... Think about it people... Will her husband have access to government secrets? Will we begin to see items from the White house on Ebay?

I'm trying to figure out what she did wrong.
1) The report agrees she was within her power to fire Monegan for any or no reason.
2) The report agrees she had cause to fire him due to work-related concerns and his alcohol abuse.
3) The report agrees she didn't fire him, but reassigned him. He chose not to accept the reassignment.
4) The report agrees no one at any time told or even asked him to fire the trooper who Tasered his own stepson, issued death threats, and engaged in drunk driving in his own patrol car.
Where's the abuse of power, again? Seems to me it's on the side of the Dem state legislator who stupidly crowed to the press about providing Obama with an October surprise. Or maybe the investigator who was friends with Monegan. Or maybe Moneghan, who didn't think he'd been fired for not getting rid of Wooten until a far-left blogger Palin had defeated for governor "reminded" him. Or maybe the state troopers union who thought 10 days suspension was too harsh a punishment for a guy who did all the above.
How many kids does a trooper have to Taser before he gets fired? How many times does he have to drive drunk in his own patrol car? How many death threats does he have to issue?
I wish Palin had fired Wooten. That's not a scandal; it's a public service. But there's no evidence she tried to do anything like that.

No laws were broken, and the report can only say that the Trooper issue was "probably a contributing factor", meaning it is the opinion of the investigator, not fact. The investigator's opinion was well-known before the investigation started.

"Bipartisan" in Alaska isn't quite the same as "bipartisan" in much of the rest of the county. There are effectively two Republican Parties in Alaska right now: the "good old boy" network led by Murkowski, Young, and Stevens, and the reform-oriented conservative one of which Palin is chief.
That's why any real reformer's job is so tough. The crooks in your own party won't tolerate you standing up to them.
The opponent has communist, activist, socialist, radical ties that could affect all of us that is the difference. Is this what you want for your children????
the talking points about obama are all factual. Do you agree with who he hangs out with even his mentor and now ex pastor? He will probably diown the US , the same way he has other relationships that he has had.

Since, sadly, we probably have to choose between someone who abused their power to get rid of a insubordinant, verses someone who abuses power to get sweetheart deals on mortgages and takes contributions from very questionable sources, that's a tough call. Oh wait, one is running for vice-president and one if running for president. Vote for McCain/Palin - the lesser of the two evils.

Read your two quotes and you'll see that there are two different issues. One issue is that she had a lawful right to fire Public Safety Commissioner Walter Monegan. The other issue is that it was a violation of the Ethics Act for her to use her influence as Governor for personal reasons, ie, trying to get her former brother-in-law, Wooten, fired.
Palin is a hyporcritical liar and a fraud. She isn't qualified to be governor of her state, let alone VP of the whole darn country.

The report said she 'unlawfully abused her power.' You republicans can whine all you want, but the truth is clear here. Palin's actions were highly unsualy, unethical, and unlawful, and she's tried to cover up her actions by lying to the american people. And this is not some drummed-up attack over something that happened 20 years ago, this is in her current, actual role. Seems pretty clear to me - Palin is a disgrace to this country and unfit to be on the ticket. Simple as that.

So Palin abused her power. Who did it hurt other than the trooper who was reinstated to his job. He should not have been reinstated with the issue of using a taser on a child and driving while drunk. No one's defending Wooten, but he isn't the issue. The question is whether Palin's actions and behavior were ethical, appropriate and lawful. The report found they were not. Clearly there was massive conflict of interest - she was warned about this multiple times, but could not control herself or the first butthead Todd Palin. As a governor she had many options to keep her family safe - she could have increased the security detail, but did not. The point is the she didn't like Wooten and wanted him fired; Monegan wouldn't do her bidding so she fired him out of spite. That's abuse of power, and recklessly inappropriate.

Last I checked, Opinions, aren't suppose to be part of the "News", but the Editorial pages. and this would be a faulty opinion, because then what? Given all the Valid reasons for firing the guy she was suppose to ignore those and not fire the guy because someone may think she was doing it for personal reasons????

and as it clearly says, she is not guilty of any "Unlawful" acts as you state. In fact the report specifically says she acted within her Constitutional powers. Everything else was Branchflower(a known Obama partsian) Opinion. He has no authority to charge her with violating a law, which if group with Authority to do so did, then she would then have acted "Unlawfully" as you state.
I trust the Observer will be correcting the error.

Its a lie to state she "unlawfully" did anything. I suspect the media knows this, the main thing is the Headlines right, which is about as far as any reads for info anyway.
This is a just one big red herring thrown out here to get everyone upset over a relatively insignificant issue. Palin tried to get a bad cop fired. Big deal. That knucklehead should be in jail for child abuse and endangerment. Who in their right mind would tazer a child?
As for Monegan, if he was not willing to support the Governor in her agenda for public safety, then it is in with in her right to find someone who will. again no big deal. Why is this an issue? I'm sure there are other more important points to discuss than this over inflated non-issue. I find it interesting the timing and the rush to judgement on a national level for an issue that was not really an issue for Alaska. It would be a nice world if the media simply presented all the facts and left the opinion making to the reader instead of telling us what our opinions ought to be.
Perhaps the problem is that the tasering a child, drinking in patrol car, etc.. never became an issue until there was a divorce/custody battle happening. That would be the problem. And perhaps the problem is not going through the appropriate channels and trying to take things into your own hands, then it becomes revenge and using power for personal gain.

Alaska is the first line of defense in our missile interceptor defense system. The 49th Missile Defense Battalion of the Alaska National Guard is the unit that protects the entire nation from ballistic missile attacks. It's on permanent active duty, unlike other Guard units.
As governor of Alaska, Palin is briefed on highly classified military issues, homeland security, and counterterrorism. Her exposure to classified material may rival even Biden's and certainly by far exceeds Obama's.She's also the commander in chief of the Alaska State Defense Force (ASDF), a federally recognized militia incorporated into Homeland Security's counterterrorism plans.
Palin is privy to military and intelligence secrets that are vital to the entire country's defense. Given Alaska's proximity to Russia, she may have security clearances we don't even know about.According to the Washington Post, she first met with McCain in February, but nobody ever found out. This is a woman used to keeping secrets.
She can be entrusted with our national security, because she already is.
Is this another reason the left does not want her in Washington?
